Immigration Checks
The Council provide a discretionary service to provide property assessments for immigration purposes. The legal basis for this processing is a legal obligation. The Council collect personal information about you in order to assess the suitability of the property, specifically when someone wants to join the household. Under the Housing Health and Safety Rating System, the council check for overcrowding. Private sector landlords are required to check the immigration status of their tenants under the Right to Rent Scheme to avoid sanctions. This information is required under The Immigration Act 2014.
The data collected is:
- Name
- Date of birth
- Contact details
- Household details
- Incoming person details
- Landlord / agent contact details (where relevant)
- Images
- Gender
- Family demographic
- Health
This information will be shared by members of staff in Private Sector Housing and in the case of enforcement, the Home Office.
Records of the date of the checks and copies of the documents will be kept for a period of 12 months after inspection.
This information will not be shared/sold to any other service/organisation unless we have a duty to do so under law. This data will not be transferred outside of the EEA.
